I'd look to see what the law in her state says about selling old tires.

Looks like from what everything I have read on internet, 6 yrs is the maximum by Federal law. There have been several reports that when a tire gets old, it cracks and can actually separate, causing the tire to explode, and in turn the vehicle crashes. Some states have there own set of laws regarding this and in most cases are less than 6 yrs, but never more than.
So, sounds like ebay will have no problem deciding who wins this case :2thumbs:

There is nowhere in the add where they say the tires are from 2005. The woman Brigitte is not giving a refund on the purchase when I state that the tire is 9 years old. She just won't do anything about it.
This really sucks!!! :bang::bang::angry:
So watch out doing any business with Bourget Bike Works and always ask when the tires are produced before buying any tire. That's at least the lesson I've learned now.


Ya exactly why the tires are only $190! Unfortunately sometimes a deal IS too good to be true and you get what you pay for. Sorry your having the issue I would have tried the same thing, thanks for the heads up!

If it's against the law to sell the tires after the 6 year born date, shouldn't the seller be forced to destroy the tires. Also, if they can be sold to the public with just under the 6 year deadline, shouldn't they last at least a couple years beyond that date. Seem like if it dies at six years, then the sell date would have to be moved to 4 years or so.Seems like a lot of unanswered questions. Still:confused:
 
As far as I know there is no law that prevents a retailer from selling tires that are old,.....from any state. There have been bills introduced over the years, but nothing has come of them. There's a lot of push back from retailers and manufacturers. Hard to believe isn't it.
 
On one hand the retailers and manufacturers recommend and have average life of tire use, but when it comes to legislation they say there's to many variables to put an exact time on them.

The 6 year mark is not the last year to be sold, it's stated that the tire becomes unsafe after 6 years.
Yes there are a lot of variables...Sunlight is a major one. Climate as well.
The way I have heard it best described is, think of the tires as being like a rubber band...the rubber band when new, stretches with no signs of cracks....when it gets old, as soon as you start to stretch it out, you see cracks in it. If you try to stretch that rubber band out as far as you did when new, it will most likely break.
Most tires fail/blow out due to under inflation. The heat that is created due to being under inflated, causes the tire to blow out. Most people do not check their tires on a regular basis, and because of this, most are low on air pressure.

Hi Everyone,
I escalated the case to ebay customer support since the seller didn't want to do a refund on the 9 year old rear tire I bought on ebay from Bourgets and they gave me right so I got my money back!
Yeeeesssss!! :):):):lol::lol::lol::up::up::up:
It's good when you can use the ebay buyer protection and get the refund in that way.
So watch out for those 330 tires from Bourgets so you don't get screwed.

FYI, I contacted them through ebay about 2 weeks ago and asked what the date code was on the tires, funny but I'm still waiting for an answer. :down:

Hope you left a negative feedback and why you were leaving it! I refuse to purchase from people with bad feedback. When you see something on Fleabay you want then check the sellers history. Way too many people screwing people out there!!!!!!!
