Damn! Man, that does suck. But as you already know, you did several things wrong. Frankly, if I'm selling my bike no one rides without a 100% down payment and a written agreement before they go anywhere - if they wreck it, they've bought it. PERIOD. But that's 20/20 hindsight. Sorry. Also if that guy didn't end up in the hospital from the accident, he would've by the time I was done with him.
Good news is Progressive is pretty good, generally. Based on your photos, there's a decent chance it can be declared as totaled. Got my fingers crossed for you, dude.

its been many years (like 20) since law class in college but there is a terminology called "bailment"
which states, if you borrow or come into possession of the personal property of another, you must return that personal property to the owner in the same condition that you received it in, absent ordinary wear and tear.

sue this asshole for any loss..open and shut case

Your luck sounds like mine. If it were not for s@it luck i'd have none at all. Chances are they will total it out. Insurance companies seem to be real good at doing that with bikes. As others have have said, if I ever put mine up for sell, bring the cash, put it in my hand, if you wreck it, it's yours and the c.cash is mine.

What a wild story, story straight out of the those AllState commercials. Hopefully you don't end up eating too much out of this deal! Good luck keep us posted.

I agree I think insurance will total it, they don't like having the extra liability if something goes wrong down the road because one of their adjusters missed something. And it's easy on a motorcycle to miss just a slight tweak or crack in the frame.

Wow that sucks! Sorry to hear you have this to deal with that, and hopefully the intent of that Allsate commercial doesn't happen with your insurance company.

It is definitely a write-off for the Insurance Co. They will normally estimate damages and write-off if it is more than 50% of vehicles current value. The pics show way more than $10k in damage when you take frame repair and repaint into account.

Just hope that your Ins Co is fair on your payout.

The gentleman who was riding your bike...isn't he responsible too? I mean won't HIS insurance cover some of the damage to your bike? I hope there is a silver lining in this situation because it really sounds like he shouldn't have been riding something he couldn't handle. I hope it all turns out as best as it can.

You know you're advising him to commit insurance fraud, right? If the bike is totaled and the owner does not buy it back, the insurance is paying him for the bike as is, NOT looted. Just so you know, you can pay major fines and/or go to jail for insurance fraud. This also helps to raise our insurance rates...Just a little FYI since you are on a public forum on the internet. :spank:

Make sure you snag the EHC as that will get the deductible covered.
