Class Action

I want to sue somebody too! I have this repeat issue of burning the top layer of skin in the roof of my mouth almost every time I eat pizza cooked at home. :job: This type burn could get infected and possibly cause death if not properly treated. If an old lady can sue McDonalds for her coffee being too hot, then this should be an open and closed case.:cheers: Has this ever happened to any of you? Maybe we should take a poll. I think this is more of a class action that may have happened to thousands, maybe even millions of pizza eaters. Who's with me?:loony:

Most of you know about all of my problems with my 08' Pittbull. I too have had problems with my gas cap / tank.

Bottom line - never put more than 3.5 gallons in your 4.6 gallon tank.

I've got to contact them about my tank bubble around my gas cap before my warrenty expires in December.

Best of luck to you! Let the few remaining folks at BDM help you fix the problem. :2thumbs:

This apparently is an issue with just the '08 Pitbulls. My '05 never has leaked. I'm sure the design changed since then.

I also only fill the tank up to about 3.5 and tighten the cap only just enough. Don't have the problem now that I use these mesures but still bumbs me out that we have to do this on our bike's  I am keeping an eye out for any bubbling.

Guys, cute him some slack! Holy shit! He comes on site with a problem, and is looking for help and guidance, not a whole pile of shit to be dumped on him.

I had a problem with my master cylinder leaking and it craped out Ed's $$$$$$ paint job on my bike. I understand how he's feeling. Now lets take a look at his issue and try to give some support here.

Is this what our forum has turned into?

I had the paint on my chopper start to go bad after 3 years. They sent my dealer a tank for me to use while they painted mine. They went the extra mile for me.

Bond ain't Brooklyn Rub! You've been livin' under that damn bridge too long. The only time I got that far south was when all the bars in Hattiesburg would close at Midnight and we would go to "Toot and Tell It" bar or the Owens Club. Dem Bond girls bad news. :spank:

Have any of you with leaking caps tried putting a larger 'O' ring on your cap for a better seal?

You guys are funny, yall crack me up with those comments! I mean its really funny how yall bash this atago guy because you feel its ok to spend 25-35 thousand bucks and most of you put yourself in debt for 5yrs to pay for it and feel its ok that your bike falls apart around you and you have to spend hours upon hours to repair it to where it keeps truckin down the road then make the comment of "I wouldnt own anything else, BDM, none better", now that there is the funny shit!

I personally filled against them on BBB last yr, yep, my bike was outta warranty when I did it but I believe that since they knew there was a problem with the ehc and did nothing about it then I had a legit reason, and in my opinion the ehc is a major safety issue, if your on a highway late at night and the ehc craps out and lights are out, somebody is gonna run over your ass with a car/truck, and that beautiful custom bike that everyone loves so much will be a big pile of scrap metal under the front of the car/truck.

Now my last ehc went out two weeks ago so I bought a wire plus from Jake, so hopefully after this install I can ride a little less worried about breaking down, cause as we all know, sittin on the side of the road sucks, and thinking about it while riding sucks too!

So, if this guy wants to file a class action, no big deal, he wont hurt bdm by himself, but if enough bdm riders out there join then it is a big deal, but remember this, if there are enough to hurt bdm, then that means alot of people out there are tired of putting up with the quality that was put in thier bike, and that means that he has a legit reason to start the suit to begin with.

If that was the issue I'm sure he would get all the help he needs. This guy wants to sue and nothing more! I'm truly sorry to hear about your big $$ paint issue you had but did you want to sue Ed about it? I feel his pain, my paint bubbled too, but would never go to that extreme until I have exhausted all other options and then say to myself... Is it worth it?

That sucks. I'd probably be pissed too. My '04 Pit (knock on wood) hasnt given me any problems whatsoever. Although, I did spill gas all over my tank this weekend. :bang: 1st time in 6 1/2yrs. Wasnt paying attention for 1/2 a second.

I had a Fatboy that if I filled the tank full, would leak gas. I routinely fill my Pitbull, & RoadKing to the bottom of the insert and have never leaked a drop to my knowledge.

Hope a fair solution can be found for everyone. Sounds like it is a widespread prob.

My '08 Pit did exactly what the person who started this thread mentioned. I talked with the guys at the Big Dog trailer in Sturgis and they were aware of the issue and said they would fix it. He first said for me to remove the cap and look and see if there was a "white piece" in the cap itself. He said if there was to remove it. Well, mine didn't have one so nothing I could do there. When I got home I took it up to Strokers and they contacted Big Dog and they said to ship them the tank and they would fix. Only took about 2 weeks total and it was back and installed. They said they put a whole new tank on it and I noticed that it was a slightly different cap as well, as the old one didn't have the "safety stop" when you screwed it on. It is like on many cars where you tighten it down and it starts to click when tight. The first one didn't have this, but the replacement did. When I went to pick it up, I unscrewed it and looked for the "white piece" and Derrick in the shop told me he already removed it. They claim the issue arrives from either over-filling or improper venting. I told them I never filled it above the "ring" inside the tank so it had to be a venting issue, but like someone mentioned, even without over-filling, a couple of times I did notice fuel come out around the cap when stopping soon after a fill-up.

Anyway, hopefully this won't happen to mine again, but looks like it is just an issue that they haven't found a complete solution to yet. I am very interested in the flush mount cap if someone can please confirm the EXACT one used, if it did indeed stop their problem. I also think Big Dog will work with you to fix your problem, but can also understand the frustration of being without your bike while it just gets repaired but never finding a solution to the problem. You know that whole saying of the definition of insanity, right? Seems that doing the same thing over and over isn't actually rectifying the root of the problem, so if someone does know if a true fix, and if it is as simple as the flush mount cap, I am sure Big Dog would much rather install a $50 cap than keep painting these tanks!

Bob works his butt off for them and goes above and beyond. How far out of warranty do you think the bikes need to be before he stops good-willing repairs? Out of warranty is out of warranty--period. Just because he doesn't give the answer one might want everytime does not make him a "turd". I personally handled TexasRaider's issue and know that his tank was recieved by BDM and back to our dealership and picked up by him in exactly 2 weeks. There's nothing shi**y about that...and that was thanks to Bob and the paint team at BDM.

Amy,
If you have something to say, by all means say it. You're such an intravert! Come out of your shell honey. Are your panties in a wad or were you just in Rub's thong pull a few weeks ago?

OK, I'm just kidding Amy. I have to agree, when the warrenty is out,,,,it's out. Don't expect anything free after that. You should have gotten the exteneded warranty!

That's a bunch of bullshit, and not something I would stand for. Bad EHC's and crap like that is one thing. It's a simple parts failure but gas coming out and ruining your paint job is something totally different. It's dangerous and in my book is no different than dropping the bike over. Don't know how many guys are having that problem, but just because Big Dog is on hard times doesn't give them the right to slap shit together and call it a bike. Get a lawyer to write them a letter. It won't cost you much and should get their asses moving in the right direction.

Well, I didn't know the "Amy" that was helping me was you! Personally, I think Amy, as well as the ENTIRE Strokers staff, top to bottom, is first class and they did take care of me once again. But keep in mind it was a mutual effort on both parties. I gave them the information they asked for a they took it from there, problem solved. Now, I agree, out of warranty IS out of warranty, but I also know that when you have a recurring issue, such as this one in particular, companies do tend to want to work with you to resolve the problem and keep a strong customer base, ESPECIALLY in these economic times. I bet that if you expressed to them, in a cordial manner, your displeasure with this issue, that they would indeed work with you. I can stand on both sides of this fence, so to speak. I understand the frustration from a consumer standpoint, but I also understand the business side or warranty issue. I actually like to go through my Big Dog Dealer (Strokers) as I KNOW they will take care of me, be it through Big Dog or on their own. When I first brought the subject up to Alan, he said, "don't worry, WE will take care of it one way or another." That, my friends, is customer service and why I think it is instrumental that you have a good relationship with your dealer and stay loyal. Times are tough, but those who take care of their customers WILL prevail, they always do.

So my 2 cents worth, take a step back, a couple of deep breaths, and maybe attack this from a different angle and see what happens. Trust me, you won't win a class action suit in this case. Warranty is expired, and even though it is a problem that has been reoccurring, you can't prove that you never over-filled the tank (don't get mad at me, this is just from a legal standpoint) and like others have said, you will spend way more than what a fix would cost you.

I know it sucks, but I would try to do all I can to make the best out of a bad situation. Heck, they will probably make you a good deal on a Wolf if you did, and swallow the cost of the repair in the discount on a new one? You never know!
