Spear Air Intake Question

I have a spear intake that the previous owner installed, currently points forward and is connected with three allen bolts. Also currently installed DM's 5" forward controls and this intake is now even more in the way of my long-assed legs. Went to remove and rotate upward to get it out of the way but the bolt holes do not line up as they are not equally spaced around the perimeter. Don't know if any of you are familiar with these things, but are there different holes on them under the gasket (don't want to remove the gasket until I know for sure) that allow me to rotate this intake to the veritcal position?

You should be able to. I did on mine and also it runs better in the vertical position (95% of members agree on this one). Did you take the "bowl vent screw" out? If you didn't, it´s highly recommended you do.
 
It may be a d&m air filter with a generic bracket. This is what I had when I purchased my air cleaner from a middle man. Take some pictures and post them.
