Hey look i am sorry to hear all this but its my experience being a small buisness owner that there is a reason no one will touch your bike,now i will bet my bottom dollar its cause we are only getting one side of the story...for BDM to get involved and then pull all relationships and communication with you its obvious that you must have upset the apple cart,and if you are in the middle of litigation as soon as you cryed 'I'M LAWYERED UP" WELL HELL I WOULDNT TOUCH YOUR SHIT EITHER"....Your the onne that made the decision to not accept a brand new bike and continue fighting the 'GOOD' fight so now you must lay in your bed ...........so i guess you wont be riding for awhile because its more important to proove your point.....personally if it means so much to someone to ride...well to me that seems to be the objective here,so when BDM offers the bike to you ...well that wouldve been your best shot to ride....if you felt you were wrongfully treated,hell you shouldve asked 'em to throw in a t-shirt.........now where are you???? and then as time goes by and the economy worsens and BDM falls further you will be left with nothing........ BIG DOG has a few good lookin shirts left.......i guess all this depends truelly on how bad you wanna ride......

I certainly don't know all the details and everyone makes valid points in regards to the survival of BDM but I would have taken the new bike??? It certainly does not make up for your pain/grief leading up to that offer but not sure as a business what else they could do for you??

It may not be comparing apples to apples but if I purchase an iPhone and have nothing but troubles with it but finally after many calls/email/complaints to ATT they give offer me a brand new one but it has been sitting on the shelf for a year I would take it happily. As a consumer (of course throwing out the CS issues) that would ultimately be what I would want a replacement.


No disrespect to your situation just my thoughts.

There are a couple of things that I didn't mention and not going to on here about what came with me getting the offered bike. I understand that most of you would have taken the bike but what good is a new bike with a warrenty that may not be any good soon? And if I were to have problems with the bike offered, where am I to take it? Its not like I can take it anywhere now. Like jimizee028 said if he knew that I would lawyer up if he f'ed my bike up he wouldn't touch it. And now that most dealers and service centers around me (within 200miles) know me and know that I have a lawsuit, who would even touch the bike offered?? Noone seems to think about that. Plus if I did find a place to work on it how would they get parts because it it more than likely wouldn't or couldn't be a BDM dealership? Plus if they go out of buisness, which I have stated before, I like thier bikes, love the way they handle and ride, much better than any H-D I've ever riden. How then am I to get work done, and I know most people will say do it youself, but why have a warrenty if your going to do it yourself?

Which on another note, jimizee028 I know you say this is one sided and you would be correct to win that bet, because the dealership that I used would say they did nothing wrong. But let me ask one question since you are a buisness man, if the dealer that I'm sueing did nothing wrong, then why is BDM not protecting them? Most poeple know that a manufacture will protect thier dealer if they did nothing wrong, but BDM is not protecting this one. Making them hire there own lawyers and such??

I'm not try to start anything or open a can of worms this started out about BDM going out of buisness, and me and another made commits on what we had heard. Maybe I should of. So from this point forward I will not talk about the lawsuit on open forums. I don't want to shake the apple cart and be kicked off this site. I have a few friends on here and like chatting with them and enjoy reading the forums. I hope BDM all the best I do. In these times it would be bad for the people out there to lose thier jobs. I hope all of you will respect the choice I'm making on this and trying to put out any fires before they get out of control. Thank you
