I was pulling out of my garage when a worker at the condo complex I live at clipped my front tire with his truck as he was driving past, and traveling quite fast for being in a parking lot. I was still half way in my garage. He sent me and the bike tumbling. I initially did not see any major damage to the bike, because my leg was unfortunate enough to take the blow, being crushed between the bike and the pavement. After further inspection, the only damage, besides my leg, is an almost invisible scuff on the very bottom of the heat shield, and an ever so slightly bent right foot peg with a scuff on the bottom. To my surprise, the bend was enough to cause a leakage of brake fluid. I am not sure where it is coming from. I called the police and they stated that due to the incident being on private property, they will only take statements and not pass judgment or make an official ruling, so I will most likely get stuck with the repair bill for the bike.

That sucks, I hope your leg is okay. If the guy who hit you works for the condo complex they are liable, if you threaten to sue them, there's a good chance they will pay for your repairs (it costs money to go to court). Let us know how it turns out.

That blows,I would try talkin to the dude,get an estimate,if that goes nowhere fast talk to the condo peeps.Maybe they'll at least split the bill,or take him to court(if it's worth it)Hope your leg is OK.FYI,alot of LEO's usually don't make an official ruling,unless someone is seriously injured or dead,but that's a hole other ball of wax.They usually write each side's version,write that they did not witness the incident,and let ins co's figure it out.

Yeah, hold the condo management liable. Doccument everything--who, what where, when, etc. and take photos. The police report has the time of the incident. It's nice to be able to throw the officers name around when making requests (demands) from the condo management. As has been said, if they know you are going to get police involvement, or lawyers involved, they will just settle because of the cost to go to court. Good luck. I hope things go your way.

I would have had an accident report done on it and turned it in on their insurance. Any time you have an accident get a report on it, then they can't just say no later.

The condo manager was upset that the police were involved and said that it was my fault anyway, and that they had planned on covering the damages to the truck. If the estimate is less then $500 for the bike repairs, I will eat it. I don't like to make waves if I don't have to, this is just unfortunate.

I would take this MF and his grandson both to the cleaners. Get a lawyer, notify you insurance and don't just make waves, ROCK THE BOAT. It assholes like them that usually get off the hook with trash talk. You may have to move, but they should foot the bill for all, damages, Dr Bills, Attorneys fees and Court Fees. If you let them get away with this you are crazy . Did the Guy even stop if not you can charge him with hit and run, failure to render aid, speeding. Do yourself a favor and Rock the Boat Baby.

Not for nothing, but if the police responded and spoke with the operator of the truck, maybe they won't make a determination of fault, but they could surely summons him for leaving the scene of an accident.

Thanks for the support guys. The knee is still sore and stiff. I especially feel it going up and down stairs. The rear brake master cylinder was leaking. I made sure all the bolts were tightened and haven’t seen another drip. I estimate 20ml leaked out, shouldn’t be a big deal, right?
